The conflict over the classic problem of philosophical anthropology, i. e., what man actually is, is not only a conflict about what – X – determines something to be human. It also requires clarification of the manner in which something is determined to be human by the X in question. There being different options for the latter, the classic anthropological conflict concerns not only definitions of being human, but also models of being human. The present paper investigates four such models: (...) the addition model, the interior model, the privation model, and the transformation model. While the first will serve as a baseline for comparison, the three other models will, in order to escape the danger of making too formal an argument, be discussed exemplarily, i. e. by focusing in each case on a certain proponent of the respective model. Those proponents will be Martin Heidegger for the interior model, Arnold Gehlen for the privation model, and Helmuth Plessner for the transformation model. (shrink)

Studies of the history of 20th century philosophy usually suggest a sharp antagonism between Martin Heidegger on the one hand and Philosophical Anthropology, as founded by Max Scheler and Helmuth Plessner, on the other. In contrast I will argue that one of Heidegger′s texts, namely his lecture The Fundamental Concepts of Metaphysics. World – Finitude – Solitude, held in the 1929/30 winter semester is in fact very close to the theoretical approach of Philosophical Anthropology. The measure for determining this proximity (...) is taken from Joachim Fischer′s study Philosophische Anthropologie. Eine Denkrichtung des 20. Jahrhunderts . Its main systematic thesis posits that the theoretical approach of Philosophical Anthropology is constituted by a core identity, which can be accurately defined by a set of features. In my paper I use these features heuristically to examine the question whether Heidegger, who prima facie is not an adherent of the theoretical approach, in his lecture The Fundamental Concepts of Metaphysics actually does argue like an exponent of Philosophical Anthropology. This paper deals with causal analysis in the social sciences. We first present a conceptual framework according to which causal analysis is based on a rationale of variation and invariance, and not only on regularity. We then develop a formal framework for causal analysis by means of structural modelling. Within this framework we approach causality in terms of exogeneity in a structural conditional model based which is based on (i) congruence with background knowledge, (ii) invariance under a large variety of (...) environmental changes, and (iii) model fit. We also tackle the issue of confounding and show how latent confounders can play havoc with exogeneity. This framework avoids making untestable metaphysical claims about causal relations and yet remains useful for cognitive and action-oriented goals. (shrink)

Nicolai Hartmann hat philosophische Studien zur Erkenntnistheorie, Ontologie, Ethik, Philosophie des Geistes und Naturphilosophie geschrieben. Die Beiträge des Bandes gehen davon aus, dass seine Arbeit auf all diesen Feldern im Zeichen der Verabschiedung der Systemphilosophie sowie der Begründung einer Konzeption systematischen Philosophierens steht. Im Zentrum von Hartmanns Denken steht das "Kategorienproblem", d. i. die Frage nach den elementaren Strukturen der Wirklichkeit und der menschlichen Erkenntnis. In seinem Bezug auf die philosophische Tradition und seiner Hinwendung zu den Natur- und Sozialwissenschaften unter (...) Einbeziehung auch der alltäglichen Erfahrung macht Hartmann deutlich, dass er an dem Anspruch festhält, die Phänomene der Lebenswelt, Wissenschaft und Geschichte in einem einheitlichen "Aufbau der realen Welt" zu integrieren, ohne ihre Heterogenität und Selbständigkeit zu leugnen. Die Beiträge konzentrieren sich daher auf das Konzept einer "Neuen Ontologie", das Programm der "Kategorienforschung", den Wissenschaftsbezug von Hartmanns Denken, dessen Relevanz für die philosophische Anthropologie und die Problematik des geistigen Seins, der Freiheit sowie der Geschichte. The fourth of Herodas is entitled in the papyrus —a title which very well describes the beginning and end of the poem, but disregards the middle, the most important part. The poem divides naturally into sections as follows: 1–20a; 20b–38, 39–563, 56b–78; 79–95. In we hear one of the women of the title carrying out the offering to the god. This section has been examined in detail by R. Wünsch, ‘Ein Dankopfer an Asklepios’, Arch. Rel. Wiss. vii , 95 ff., (...) who shows that it corresponds closely to the form of prayer used in real life, starting with the invocatio of the god, comprising greeting () and mention of his dwelling-places , family (parents, Koronis and Apollo. Desires are often taken to be the basis for all practical reasons. I introduce one of the most powerful arguments to sustain this view: the argument from motivation (sec. 1). In section 2, however, I develop an equally powerful objection to desire-based approaches showing that desires are not suited to accommodate the justificatory role of reasons. The objection suggests that at least one of the premises of the argument from motivation must presuppose that only desires can explain actions. Die Phänomenologie stellt eine der Hauptströmungen der Gegenwartsphilosophie dar und findet in zahlreichen Wissenschaften sowie in Praxis und Therapeutik starke Resonanz. Nach 120 Jahren Wirkungsgeschichte füllt die Bibliothek phänomenologischer Werke zahllose Bücherregale und selbst für Expert:innen ist die Forschungsliteratur mittlerweile unüberschaubar geworden. An allgemeinen Einführungen sowie spezialisierter Fachliteratur mangelt es dabei keineswegs, wohl aber an einem Handbuch, in dem sowohl der Vielfalt der historischen Entwicklungen als auch dem berechtigten Wunsch nach innerer systematischer Kohärenz Rechnung getragen wird. Das Handbuch Phänomenologie (...) schließt diese Lücke. Ausgewiesene Autor:innen bereiten in eigens für diesen Band verfassten Artikeln komplexe sachliche Zusammenhänge übersichtlich auf. Durch seinen Aufbau eignet sich das Handbuch sowohl für Anfänger:innen als auch für Fortgeschrittene. Anhand bündig präsentierter Grundbegriffe und Verfahren konturiert das Handbuch die Spezifik der phänomenologischen Methode, spart dabei jedoch nicht die Kontroversen und methodologischen Neuausrichtungen aus, die von ihrer Lebendigkeit und Vielstimmigkeit zeugen. Ein umfangreicher Schlussteil ist der Rezeption und Anwendung in einzelnen Wirkfeldern gewidmet. Als Hilfsmittel zur eigenständigen Erschließung der phänomenologischen Denkrichtung und zu ihrer Anwendung auf aktuelle Probleme zeichnet sich das Handbuch durch seine Leser:innenfreundlichkeit und einen stark forschungspraktischen Bezug aus. The article discusses the issue of the justification of experimenting on human subjects from the point of view of the individual participant. The discussion is conducted on three levels, which can be viewed as a hierarchy:I. Rationality: does one have good self-regarding reasons to subject oneself to medical experimentation?II. Justice: does one have a duty or an obligation to take part in medical research?III. Virtue: ought one contribute to the long-term attempt to promote medical knowledge and the overall health of (...) human beings?Rationality is shown to have only a limited force in such a justification, since many experiments cannot be shown to serve the interests of the participant in any way. Justice fares slightly better, since it is based on the idea of a social contract which goes beyond individual prudence. But, since many medical experiments promote the health only of future generations, the condition of mutuality, which is one of the bases of a social contract, is not satisfied. Thus, the ultimate reason to take part in medical research is associated with the supererogatory volunteering of people, who are motivated by the wish to contribute to a highly valuable enterprise with no expectation of return.The three types of reasons are complementary rather than exclusive, and the potential failure of all of them may lead to the undesirable commercialization of the field. Der Beitrag untersucht die Frage, ob und wie medizinische Versuche an Menschen aus der Sicht des einzelnen Teilnehmers gerechtfertigt werden können. Die Diskussion dieser Frage wird auf drei Ebenen geführt, die sich in einem Stufenverhältnis darstellen lassen,I. der Ebene der Zweckrationalität: Gibt es gute Gründe, und zwar durchaus des individuellen Eigennutzes, sich selbst für medizinische Versuche zur Verfügung zu stellen?II. der Ebene der Gerechtigkeit: Besteht eine Pflicht oder eine Verbindlichkeit zur Teilnahme an medizinischer Forschung?III. der Ebene der Tugend: Soll man zu dem auf lange Sicht angelegten Versuch beitragen, das medizinische Wissen und die Gesundheit der Menschen insgesamt zu fördern?Es wird gezeigt, daß das Argument der Zweckrationalität für eine mögliche Rechtfertigung nur von begrenzter Bedeutung ist. Denn viele Experimente dienen den Interessen des unmittelbaren Teilnehmers nachweislich in keiner Weise. Das Argument der Gerechtigkeit hat zwar eine etwas größere Kraft, weil Gerechtigkeit auf der Idee eines Gesellschaftsvertrags beruht, die über den Horizont individueller Klugheit hinausreicht. Da aber viele medizinische Experimente nur die Gesundheit zukünftiger Generationen fördern, ist die Bedingung der Gegenseitigkeit, die eine der Grundlagen des Gesellschaftsvertrags bildet, nicht erfüllt. Der dritte und letzte Grund für eine Teilnahme an medizinischer Forschung steht deshalb in enger Verbindung mit dem freiwilligen supererogatorischen Verhalten von Leuten, die durch den Wunsch motiviert sind, ohne Aussicht auf Gegenleistung zu einer höchst wertvollen Unternehmung etwas beizutragen.Die drei Arten von Gründen ergänzen sich mehr, als daß sie sich ausschließen. Ein mögliches Scheitern aller dieser Gründe könnte zu einer unerwünschten Kommerzialisierung der Teilnahme an medizinischen Experimenten führen. (shrink)

More than a century after the publication of the two main corpora of curse tablets by Richard Wünsch and Auguste Audollent,1 defixiones are now a relatively well-established field of study. New collections, finding lists, and monographs have appeared over the last twenty-five years.2 Still, the relation to the Near Eastern sources, although noticed from the very beginning,3 has never been explored in full. Nor have there been many attempts to use the text on the tablets for investigations that go beyond (...) archaeology, epigraphy, or magic. In this note I would like to emphasise the dependence of Greek and Latin defixiones on older, oriental models, but at the same time show that the curses share some interesting features with the comparatively ‘new’ τέχνη of rhetoric, thus arguing for an interpretation of the magical incantations in the light of rhetorical theory - just as the early history of rhetoric cannot be separated completely from irrational practices and beliefs. Background Ethically, informed consent regarding randomised controlled trials (RCTs) should be understandable to patients. The patients can then give free consent or decline to participate in a RCT. Little is known about what patients really understand in consultations about RCTs. Methods Cancer patients who were asked to participate in a randomised trial were surveyed using a semi-standardised interview developed by the authors. The interview addresses understanding, satisfaction and needs of the patients. The sample included eight patients who participated in a (...) trial and two who declined. The data were analysed on the basis of Mayring's qualitative analysis. Results Patients' understanding of informed consent was less developed than anticipated, especially concerning key elements such as randomisation, content and procedure of RCTs. Analysing the result about satisfaction of the patients, most of the patients described their consultations as hectic and without advance notice. Health limitations due to cancer played a decisive role. However, most of the patients perceived their physician to be sympathetic. Analysing the needs of patients, they ask for a clear informed consent consultation with enough time and adequate advance notice. Conclusion This study fills an important empirical research gap of what is ethically demanded in an RCT consultation and what is really understood by patients. The qualitative approach enabled us to obtain new results about cancer patients' understanding of informed consent, to clarify patients' needs and to develop new ideas to optimise the informed consent. Purpose. The study seeks to clarify the preconditions for moral and legal decision-making based on the identification of axiological foundations that correlate with the moral perceptions of good and evil and psychological phenomena such as emotions. Theoretical basis of the study is to apply comparative, axiological, systemic methods. This methodological approach allows us to analyze and disclose the essence of the process of moral and legal decision-making on the basis of certain axiological prerequisites and enables to substantiate the connection between (...) the axiological and psychological aspects of taking moral and legal decisions. Originality of the work is to broaden the perceptions of the processes and mechanisms for making moral and legal decisions, which are based on the axiological dimension, in particular on the system of reference individual and social values. The study shows that every necessary moral and legal decision taken by a person is futurologically balanced in the emotional sense, rationally reasoned and morally perceptible in the context of man’s beliefs about good and evil, and realized with necessity in the personal system of reference values that determines the style and manner of individual and social behaviour in the context of material and spiritual values and is an axiological foundation for making all types of moral and legal decisions. Conclusions. Moral and legal decision-making is a social process that is connected with such a social essence of a person as rationality, which gives an opportunity to act axiologically. A person makes moral and legal decisions in a complex way, based on the unity of the moral, axiological and psychological aspects of his worldview, which are grounded on the system of reference values.
